Because TSA properly rejected CI’s late attempt to modify its bid and reasonably disqualified CI’s original bid for containing a material error, Plaintiff’s Motion for Judgment on the Administrative Record is DENIED and Defendant’s and Defendant-Intervenors’ Cross-Motions for Judgment on the Administrative Record are GRANTED. Defendant’s Motion for a Status Conference is MOOT.

Barring some type of corrective action being taken by the government, it appears it will be late Winter / Springtime of 2025 before we get any final ruling. The Joint reports are due in early February and, if required, oral arguments will follow shortly thereafter.

Those hoping for a smooth landing on this recently awarded pair of high-profile Transportation Security Administration (TSA) BPAs will note that this now appears set for an elongated battle.

On the heels of GAO siding with the government on a recent protest, Competitive Innovations has now filed a formal challenge with the Court of Federal Claims. Details as to the grounds for the protest have not been revealed at this time, but you can expect the case to mirror much of what was included and detailed in the GAO decision.

The courts provide the challenger with the ability request more detailed information. As a result, a court challenge can last for months.

Both RELI Group and HIVE Group, the two named awardees on this contract, have jumped into fray as intervenors, allowing them to get additional information and to fight alongside the government to protect their wins. More will be shared as it is made available.

Competitive Innovations, LLC (CI), of Arlington, Virginia, protests the Department of Homeland Security’s rejection of the quotation CI submitted in response to request for quotations (RFQ) No. 70T05023Q7500N001 to provide integrated program management support services (IPMSS). The agency’s rejection was based on CI’s failure to comply with the solicitation requirements regarding mapping of labor categories to CI’s federal supply schedule (FSS) contract. CI asserts that the agency should have considered CI’s post-closing-time modification of its FSS contract. Protest at 1-2, 19-24.

Protests (and stop work orders) can make it challenging for agencies to move forward and to go about their business. Below are details on how TSA is managing until this challenge is resolved

There is no big surprise here as TSA announced plans to issue at least one short term sole source task to incumbent RELI Group until the protest is resolved and the requirements can be competed on the new BPA. The open GAO protest (detailed below) was filed this Summer, shortly after the two BPA awards winners were announced. This protest resulted in stop work orders being issued until GAO had an opportunity to weigh in with a ruling. The due date for a decision and potential reolution is just days away. Once resolved, TSA can move forward with competing and awarding a new long term set of tasks. The new tasks will have a one year Pop which would typically be plenty of time, but with this much on the line, the fights can tend to linger.
